Get Reimbursed For Bad Checks
Thousands of dollars are lost every year by businesses due to bad checks. The cost is often passed onto consumers through higher prices for goods and services. Over half the states have begun Bad Check Restitution Programs to help combat the problem. The programs often operate through the State Attorney's Office or through the county District Attorney's office.
The way most of the programs operate is that they give the bad check writer a chance to avoid prosecution. The Bad Check Writer is required to attend an educational class and pay all program-related fees. All programs give 100% of the recovered face value of the check, plus any applicable returned check fees back to the victim. Los Angeles County District Attorney Bad Check Restitution Program has returned over $23 million to victims.
The program operates slightly differently from place to place, but generally there is no minimum amount for submitting a bad check. The maximum amount varies from $2000 to $5000. There must be a documented attempt to contact the bad check writer, and they must have 5-10 days to respond. The check must be submitted within 90 days of the date of the check (for some programs the date may be within 120 days). All programs have a form you can download on their site with instructions on how to submit your claim. This is a FREE program to help you get what you are owed. Most programs require that a driver's license, photo ID, or state identification card was shown at the time the check was written, and that the information was written on the check. The written amount must be the same as the numerical amount listed on the check, and the check cannot be postdated. The check must be written to a person or business within the jurisdiction of the District Attorney's office or state Attorney's office.
